Updated 12/01/2025These Terms and Conditions (“Terms”) govern your use of the website and online services provided by the Trauma & Executive Functioning Institute (“TEFI,” “we,” “our,” or “us”). By accessing or using our website, you agree to these Terms. If you do not agree, do not use our site.
1. Purpose of the Site
The TEFI website provides educational content, research updates, nonprofit information, and organizational resources. The site does not provide medical, psychological, therapeutic, or professional services. Content is for informational and educational purposes only.
2. Who Can Use Our Site
You must be at least 13 years old to use this site. If you are under 18, you may use the site only with permission from a parent or guardian.
3. Use of Website Content
All content on this site, including text, graphics, articles, research summaries, and media, is owned by TEFI or used with permission. You may view, download, and share content for personal or educational use as long as you credit TEFI or the original authors.
You may not:
- sell or commercially exploit our content
- modify content in a misleading way
- claim ownership of TEFI materials
- use TEFI materials to imply endorsement
4. No Medical or Professional Advice
Information on this site is not medical advice, mental health advice, therapeutic guidance, diagnosis, treatment recommendations, or a substitute for professional care. Always seek qualified professionals for personal or clinical concerns.
TEFI does not provide crisis services or individualized therapeutic interventions through this site.
5. Research Participation
If you participate in TEFI research, you will receive a separate consent form describing:
- what information will be collected
- how it will be used
- confidentiality practices
- risks and benefits of participation
- your rights as a participant
These Terms do not replace research consent documents.
6. User Conduct
You agree not to use the site to:
- engage in unlawful activity
- upload harmful or malicious materials
- disrupt or interfere with site functionality
- attempt unauthorized access
- infringe on intellectual property rights
TEFI may restrict access to users who violate these Terms.
7. Third-Party Links
Our website may link to external sites. We are not responsible for the content, privacy practices, or policies of third-party websites. Visiting those sites is at your own risk.
8. Donations and Payments
Donations made to TEFI are voluntary.
TEFI is a nonprofit organization with 501(c)(3) tax-exempt status pending IRS determination. Donations may be tax deductible once tax-exempt status is approved. Any deductibility depends on individual tax circumstances and applicable laws. All donations are final unless otherwise required by state or federal regulation.
Donation processing is handled through GiveButter, a third-party fundraising and payment platform. By making a donation, you also agree to GiveButter’s terms and privacy practices. TEFI is not responsible for errors, security issues, or data practices that occur on or through GiveButter’s platform.
Licensing Fees and Payments
Organizations that license FunctionalMe™ through TEFI for research, training, evaluation, or support purposes will receive invoices through Wave, a third-party invoicing and payment processing platform. By submitting payment for a license, the organization also agrees to Wave’s terms and privacy practices.
Licensing fees, payment schedules, usage rights, and renewal terms will be described in the specific licensing agreement between the organization and TEFI. TEFI is not responsible for errors, delays, or security issues that occur within Wave’s systems.
Licensing fees are separate from charitable donations and are not tax deductible.
9. Intellectual Property
FunctionalMe™, including its name, branding, software, and all related intellectual property, is the property of FunctionalMe PBC, Inc. TEFI™ uses FunctionalMe™ and associated materials under a written license agreement with FunctionalMe PBC, Inc. This license allows TEFI™ to provide access to FunctionalMe™ for research, training, program evaluation, and organizational support.
The license granted to TEFI™ does not grant rights to any third party. Organizations or individuals may not use, copy, distribute, or rely on FunctionalMe™ software, branding, training materials, documentation, or related content without entering into a separate written agreement with TEFI™ or FunctionalMe PBC, Inc.
Any unauthorized use of FunctionalMe™ or TEFI™ materials is prohibited.
10. Disclaimer of Warranties
The site is provided “as is” without warranties of any kind. TEFI does not guarantee:
- accuracy or completeness of content
- uninterrupted or error-free operation
- that the site is free from viruses or harmful code
Use of the site is at your own risk.
11. Limitation of Liability
To the maximum extent permitted by law, TEFI is not responsible for any damages arising out of:
- use or inability to use the site
- reliance on site content
- technical failures
- unauthorized access or data breaches
This limitation applies even if TEFI has been advised of the possibility of damages.
12. Indemnification
You agree to indemnify and hold TEFI and its officers, employees, and volunteers harmless from any claims or liabilities arising from your use of the site or violation of these Terms.

These Terms are governed by the laws of the Commonwealth of Massachusetts without regard to conflict-of-law rules.
